There was a motion to accept the minutes of the February 14th meeting with 1 revision and 1 addition as discussed.  The motion was seconded and accepted with a vote of 3-0-2; 3 Yes, 0 No,
2 Abstentions.

Ms. Michele Grenier’s Agent’s Report has been appended to the minutes.

GENERAL BUSINESS

Certificate of Compliance:  140 Maple Street – CE159-1017
Michele Grenier, Conservation Agent, stated that she recently visited the site and it is in compliance and built according to the plan.  

There was a motion to issue a Certificate of Compliance for 140 Maple Street.  The motion was seconded and accepted with a vote of 5-0-0.

Comments:  A Commission member stated that he attended the Town Council meeting and a Franklin resident questioned if there is a dog path planned for the DelCarte site.  It was
requested that the Rules and Regulations for the use of Conservation Land be put on the Website.

It was also noted by a Commission member that there was 1 parcel located on Roosevelt Street on the list of Town owned land that was before the Town Council that should be readdressed on the future Conservation agenda for discussion to determine what is the Town’s plan for this parcel.  Michele Grenier stated that town officials meet and review the lands to determine which parcels are wet; she then goes and visits the wet parcels.  The Commissioner believes that the Commission should be consulted before staff makes recommendations to the Council as far as what land is going to go to Conservation.

Another Commissioner informed the Commission members of the current status of the Public Land Use Committee:  

The PLUC was originally set up to complete the five year plan, this is now completed, there hasn’t been a meeting for nearly a year, most of the members are gone or unfortunately, dead (Nick) .. I am the only one left, there is no reason to maintain it … it has no job and is now effectively disseminated, I have made a recommendation to Jeff Nutting that the PLUC responsibilities be merged into the Con Com, I have also spoken to several members of the Con Com – there appears to be general consensus, we understand that Jeff needs to make this happen by decree.


Public Hearing – Notice of Intent – Franklin Retirement Residence – 485 E. Central Street – CE159-1042
Mr. Pat Doherty, Engineer of Midpoint Engineering, and Mr. Mark Manganello, Engineer of LEC, both appeared before the Commission for the construction of a retirement residence building with associated appurtenances.

Mr. Doherty presented the plans for the site and gave the Commission a detailed overview of the project.  He also provided some background and what has transpired on the site over the past few years.

There is a perennial stream on the west side of the property and it crosses Rte. 140.  There is an intermittent stream on the eastern portion of the site.  There is wetland system on the southeast portion of the property.

The site will have 87 parking spaces.

On the north side of the site, the slope will be stabilized.  

Michele Grenier, Conservation Agent, informed the Commission members that she has walked the site with Mark Manganello and the wetlands and stream are delineated accurately.  The applicant is requesting a waiver from the 25 ft. to 50 ft. and recommended that the sedimentation to be used be degradable.

Mr. Doherty informed the Commission members that he has already received comments from Peter Williams, the Planning Board consultant, and the DPW with some minor revisions to the drainage system.

A Commission member informed Mr. Doherty that the replication should specify which functions and characteristics that are being replicated so they will be able to judge its success.

Is the replication duplicating the functions and characteristics that the Conservation Commission requires?

The location of the emergency egress was questioned and is it too steep?  

The location of the snow storage was questioned.  It was requested that it be placed outside of Conservation jurisdiction.

The plant list was met with approval from the Conservation members and Ms. Grenier stated that they are on the approved list of plantings.

Some special conditions discussed were:

  • Ms. Grenier stated that a report should be received from the applicant after the plants are established at least monthly during the growing season with photographs.  
  • The standard sedimentation control must be set forth before any earth is moved
on the site, or trees cut.
  • Snow must be stored outside of Conservation jurisdiction.  
  • No synthetic fertilizers or herbicides shall be used on the site only phosphorous free.  
  • Monthly reports must be provided during the growing season for 2 years.  
  • The replication system must be 90% survivability for 2 years.  
  • A sketch of detailed wetland replication and the plant species list must be provided prior to construction subject to the Agent’s approval.
  • No construction debris is to be buried on site underground.
There was a motion to continue the public hearing for Franklin Retirement Residence at 485 East Central Street until the April 18th meeting.  The motion was seconded and accepted with a vote of 5-0-0.

Continued - Public Hearing – Amendment Request to Orders of Conditions – 96 Populatic Street – O’Connor - CE159-991
Mr. Richard Goodreau, Engineer of United Consultants, and Mr. Thomas O’Connor, the applicant, both appeared before the Commission for alteration of the flood zone.  

Mr. Goodreau submitted a revised plan for the site and reviewed the changes for the Commission’s review.  Since the last meeting, there has been the removal of lawn from the areas highlighted in green which were extensions of the existing planting area.  It is proposed to install a second row of plantings which mimic the existing plantings.  The area is 329 sq. ft. in size and the mitigation for the patio is 297 sq. ft.


The Commission Chair questioned what is the size of the plants?  Mr. Goodreau stated that they
are 3 gallon plantings.

There was a motion to amend the Order of Conditions to include this new plan dated January 20, 2010, last revised February 27, 2013 and include the previously established conditions under the State.  The motion was seconded and accepted with a vote of 5-0-0.
